GOLLAPALLI MAHESWARA RAO Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the following order: This Criminal Petition, under Sections 480 and 483 of the BharatiyaNagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A4, seeking regular bail, in crime No.363 of 2023of Kasimkota Police Station, Anakapalli District. Q-.- `-.? 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short !the NDPS Act'). 3. Case of the prosecution, in brief, is that, on O8.12.2023, at about ll.00 am, on credible information, the Inspector of Police, Kasimkota Police Station, along with his staff and mediators, rushed near Saibaba Temple, Chintalapalem village and found Al to A3 in possession of 12 Kgs of Ganja and 2 Kgs of Hashis oil worth Rs.1,70,000/- while transporting the same. The contraband was seized under cover of a mediators report and Al to A3 were arrested. Al to A3 confessed about the involvement of other Accused Nos.4 and A5 in the present crime. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the police, on credible information, arrested Al to A3 and seized 12 Kgs of Ganja and 2 Kgs of Hashis oil on ll.ll.2024 and since then the petitioner herein is languishing in judicial remand. Learned Assistant Public Prosecutor submits that there are no <------. -I .. antecedents insofar as the petitioner/A4 is concerned and according to him, major portion of investigation is completed, but charge sheet could not be filed for want of inventory. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein/A4 on the following conditions. i) The petitioner/A4 shall be released on bail on his executing a personal bond for Rs.10,OOO/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned I Additional District &Sessions Judge- cum-Special Judge for trial of offences under NDPS Act, Visakhapatnam. ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every saturday between 10,00 am and 01.OO pm, till filing of the charge sheet. iii) Petitioner/A4 shall not go beyond the jurisdiction of Anakapalli District, Andhra Pradesh State, without leave of the trial Court and he shall make available his location through mobile raE-I_ \.
