Heard learned counsel for the petitioners, learned counsel for the respondent and learned A.G.A. for the State respondents and perused the material available on record. The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 01.03.2025, registered as Case Crime No.0143 of 20215, under sections- 61(2), 82(1) of BNS, 2023, Police Station Lisadi Gate, District Meerut, and also not to arrest the petitioners in pursuance of impugned First Information Report. Learned A.G.A. informed this Court that chargesheet has already been filed on 23.03.2025 in this case. However, he is not certain whether cognizance has been taken by the court on chargesheet or not. Petition is disposed of directing that till cognizance is taken on police report under Section 173(2) Cr.P.C., by the court the respondents shall not arrest the petitioners pursuant to the aforementioned case, subject to cooperation in ongoing investigation. In case, the petitioners do not cooperate the investigation, it shall be open for the Investigating Officer to file a recall application before this Court through learned A.G.A.
