ORDER : This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“.... to issue an appropriate writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the highhanded actions of the respondent No.3 forcing the writ petitioners to compromise with the respondent No.4 in respect of the subject matter of O.S.No.94 of 2024 on the file of the Court of Additional Senior Civil Judge, Vizianagaram, without following due process of law, as illegal, arbitrary, contrary to law, without jurisdiction and in violation of principles of natural justice and rights guaranteed under the Articles 14 and 21 of the Constitution of India…...”
2. Heard the learned counsel for the petitioners, learned Government Pleader for Home appearing for respondent Nos.1 to 3. 3. Today, when the matter came up for hearing, learned Government Pleader for Home furnished a copy of the instructions of the Sub-Inspector of Police, Denkada Police Station, Vizianagaram District, dated 30.01.2025, wherein it is stated that the 4th respondent approached the police and gave a complaint on 06.01.2025 against the petitioners herein. After conducting a preliminary investigation, the 3rd respondent realized that the matter is civil in nature, as the issue is pending before the Civil Court vide O.S.No.773/2023. The 3rd respondent issued a receipt No.01/2025, dated 06.01.2025, treating the matter as civil in nature, and the same was informed to the petitioners herein also. On the same day, the 3rd respondent has also advised both parties i.e., the petitioners as well as the 4th respondent herein not to create

any law and order problems and suggested them to follow the court directions. It is further stated that the police never interfered with the civil disputes pending between the parties. 4.
Recording the above instructions, the Writ Petition is disposed of directing the respondent police not to interfere with the civil disputes between the petitioners and the 4th respondent until and unless there is a specific direction from the competent Civil Court.
