By way of filing this criminal misc. petition, a prayer has been made to quash the impugned FIR No.307/2025 registered with the Police Station New Mandi Hindaun, District Karauli for the offences under Sections 87, 137(2), 142 and 303(2) of the BNS, 2023. 2. Learned counsel for the petitioner submits that on account of dispute of money between the parties, a false concocted FIR with miscellaneous allegations has been levelled against the petitioner. Counsel submits that even the complainant has not deposed allegations against the petitioner in her statements recorded under Section 180 of the BNSS, hence, under these circumstances, interference of this Court is warranted. (2 of 2) [CRLMP-5657/2025] 3. Per contra, learned Public Prosecutor opposed the prayer and submitted that the allegations levelled in the aforesaid FIR reveal commission of cognizable offence, which is required to be investigated by the Investigating Agency. 4. Having regard to the facts and circumstances of the case, this Court cannot adjudge the correctness of the allegations made in the FIR. Certainly, it is a matter of investigation, which is required to be done by the Investigating Officer. 5. In case, any statement has been given by the victim in favour of the petitioner, the conclusion of investigation would be submitted by the Investigating Officer in accordance with law before the competent Court of law. 6. With the aforesaid observations, the instant criminal misc. petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of.
