The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 0028/2025, registered at Police Station – Kuwakonda, District – Dantewada (C.G.) for the alleged commission of o;ence punishable under Sections 191(2), 191(3), 296, 351(2), 115(2) of the Bhartiya Nyaya Sanhita, and Sections 25 and 27 of the Arms Act.
2. According to the prosecution story, it is alleged that the complainant lodged a report at Police Station Kuwakonda, District Dantewada. In the report, it has been stated that on 01.11.2025 at about 8:00 AM, the ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.12.12 16:56:02 +0530
2 accused persons assaulted the complainant party with sticks, >sts, and a sharp-edged knife at the Village Panchayat Bhawan, where a village meeting was in progress. In the said incident, the complainant party sustained grievous injuries.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that the complainant parties were the aggressors in the alleged incident. As a result, the applicant and other persons were also assaulted by the complainant parties. In the said incident, the applicant and other persons also sustained grievous injuries. The applicant had also lodged a First Information Report bearing Crime No. 0029/2025 on 01.11.2025 against the complainant parties for o;ences punishable under Sections 191(2), 296, 351(2), and 115(2) of the Bharatiya Nyay Sanhita, 2023. He further submits that the applicant is a government servant. He is posted as an Assistant Teacher at Government Higher Secondary School, Paalnar, Vikas Khand Kuwakonda, District Dakshin Bastar, Dantewada. He also submits that the wife of the applicant is pregnant and, as per the medical card issued by the Department of Health and Family Welfare, the expected delivery date is 15.12.2025. He submits that the present applicant has no criminal antecedents, therefore, he prays for grant of anticipatory bail to the appliant. 4. On the other hand, learned State Counsel opposes the submissions made by the learned counsel for the applicant. She submits that the present applicant, along with the other accused persons, allegedly assaulted the complainant Shiv Kumar Kunjam, Santosh Kunjam, and Liga Kunjam with a knife, a wooden stick, and with hands and >sts, due to which they sustained serious injuries. Therefore, the applicant is not entitled to the grant of anticipatory bail in the present case. 3
5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the o;ence and material on record in the case diary also considering the fact that the present applicant, along with the other accused persons, allegedly assaulted the complainant Shiv Kumar Kunjam, Santosh Kunjam, and Liga Kunjam with a knife, a wooden stick, and with hands and >sts, due to which they sustained serious injuries, therefore, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant – Nanda Sori, involved in Crime No. 0028/2025, registered at Police Station – Kuwakonda, District – Dantewada (C.G.) for the alleged commission of o;ence punishable under Sections 191(2), 191(3), 296, 351(2), 115(2) of the Bhartiya Nyaya Sanhita, and Sections 25 and 27 of the Arms Act, is rejected.
