HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Case: CCP(S) No. 308/2022 IN WP(C) No. 452/2022 Tariq Ahmed Wani ..... Petitioner(s) Through :- None. Vs Manpreet Kour Commissioner Secretary Rural Dev. Deptt. and Ors. .....Respondent(s) Through :- Mr. S.S. Nanda, Sr. AAG CORAM: HON'BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 05.02.2025 01. Through the medium of the instant contempt petition, the petitioner has sought implementation of order dated 09.03.2022 passed by this Court in WP(C) No. 452/2022 by virtue of which, the writ petition preferred by the petitioner was disposed of with a direction to the respondents to accord consideration to the case of the petitioner in case the petitioner files a representation to the respondents to pass appropriate orders thereon preferably within a period of six weeks from the date copy of the order was made available to the respondents. 02. Since the aforesaid order was not complied with within the aforesaid period, the petitioner has preferred the instant contempt petition in which the respondents have filed a status report on 08.07.2024 but the order of Sr. No. 6 2 | P a g e CCP(S) No. 308/2022 IN WP(C) No. 452/2022 consideration was not placed on record with the status report. Accordingly, a direction was issued to the respondents vide order dated 25.11.2024 to pass a formal consideration order on the representation of the petitioner and produce a copy thereof on or before the next date of hearing. 03. Today, when the case was taken up, learned counsel for the respondents has provided a copy of the aforesaid consideration order to this Court vide order No. 01-BDOK-2025 dated 04.02.2025 by virtue of which in compliance to the direction passed by this Court, the claim of the petitioner has been considered in terms of the provisions envisaged in Mahatma Gandhi National Rural Employment Guarantee Act, which has been further reaffirmed in operational guidelines, Master Circulars of the scheme from time to time and subsequent fund releases through series of orders from Ministry of Rural Development, GOI and Administrative Department and have been found devoid of any merit and stood rejected. Copy of the aforesaid consideration has been provided to this Court, which is taken on record. 04. Thus, in light of the aforesaid consideration order, the order which is sought to be complied with has been complied with in its letter and spirit and this is precisely the reason that there is no representation on behalf of the petitioner today. 05. Accordingly, this Court deems it proper to close the contempt proceedings in the instant contempt petition, as the order passed by this Court mentioned (supra) stands complied with in its letter and spirit. Thus, the 3 | P a g e CCP(S) No. 308/2022 IN WP(C) No. 452/2022 proceedings in the instant contempt petition are closed. Rule, if any, shall stand discharged. 06. The contempt petition is disposed of, accordingly. (WASIM SADIQ NARGAL) JUDGE JAMMU 05.02.2025 Mihul Mihul Singh 2025.02.05 17:38 I attest to the accuracy and integrity of this document
