JUSTICE G BASAVARAJA ORAL JUDGMENT The appellant has preferred this appeal against the order passed by the LXX Additional City Civil and Sessions Judge and Special Judge, Bengaluru (CCH-71) in Crl.Misc.No.8913/2025 dated 13.11.2025. 2. The brief facts leading to this appeal is that on the basis of the complaint filed by Smt.Preethi Prem, - 3 - HC-KAR NC: 2025:KHC:51931 CRL.A No. 2374 of 2025 Banaswadi Police have registered the case in Cr.No.648/2025 against the accused for the commission of the offence under Sections 64, 74, 351(2) of the Bharatiya Nyaya Sanhita, 2023. The appellant was arrested on 10.10.2025 and remanded to the Judicial custody. Thereafter, bail application was filed under Section 483 of Bhaartiya Nagarika Suraksha Samiti, 2023 seeking regular bail and the same came to be rejected by the Trial Court. Being aggrieved by this order, the appellant has preferred this appeal. 3. The learned counsel for the appellant would submit that, the alleged commission of offence took place from 8.9.2025 to 8.10.2025. The complaint came to be filed on 10.10.2025 at 17.30 hours. On the basis of the said complaint, case was registered against the accused. There is an abnormal delay in filing the complaint. Even after filing the complaint, the accused has not absconded and police have arrested the accused. Even after lapse of more than 90 days, the Investigating Officer has not - 4 - HC-KAR NC: 2025:KHC:51931 CRL.A No. 2374 of 2025 submitted the final report as required under sub Rule 2 of Rule 7 of SC/ST(prevention of Atrocities) Rules, 1995. From the date of his arrest till this date, the accused is in judicial custody, and the accused is not required for further investigation. The accused-appellant is ready to abide by any conditions which may be imposed by this Court. On these grounds, sought to allow this appeal. 4. As against this, the learned High Court Government Pleader submitted that there are sufficient material to attract the alleged commission of offences and sought for dismissal of the appeal. 5. I have heard the arguments advanced by the learned counsel for the parties and examined the material placed on record. 6. Perusal of the complaint, it is clear that, the alleged incident is commencing from 08.9.2025 till 08.10.2025. However, the complainant has not lodged a complaint against the accused till 10.10.2025. The victim is a married lady and accused is also married. 8. The accused is not required for further investigation and the Investigating Officer has not submitted a final report within 60 days from the date of the registration of the case, as required under Sub-Rule 2 of Rule 7 of SC/ST(POA) Rules, 1995. The Investigating - 7 - HC-KAR NC: 2025:KHC:51931 CRL.A No. 2374 of 2025 Officer has not explained anything as to compliance of the mandatory provisions of SC/ST(POA) Rules, 1995. 9. Considering the nature and gravity of offences and previous antecedents of the accused-appellant, and delay in submitting the final report by the Investigating Officer and delay in lodging the complaint, without expressing any opinion on the merits of the case, I proceed to pass the following: ORDER (i) The Appeal is allowed. (ii) The impugned Order passed by the LXX Additional City Civil and Sessions Judge and Special Judge, Bengaluru (CCH-71) in Crl.Misc.No.8913/2025 dated 13.11.2025 is hereby set aside, and Consequently application filed under Section 483 of BNSS is allowed. (iii) The appellant-accused shall be released on bail on execution of personal bond for a sum of Rs.1,00,000/- - 8 - HC-KAR NC: 2025:KHC:51931 CRL.A No. 2374 of 2025 with one surety for the likesum to the satisfaction of the Trial Court. (iv) The appellant-accused shall not directly or indirectly threaten or tamper with the prosecution witnesses.
