Neutral Citation No. - 2025:AHC:121191-DB Court No. - 29 Case :- WRIT - C No. - 13014 of 2025 Petitioner :- Bharat Bhushan Pandey And Another Respondent :- Union Of India And 4 Others Counsel for Petitioner :- Pawnesh Tiwari,Somesh Tiwari Counsel for Respondent :- Pranjal Mehrotra,A.S.G.I.,Akanksha Gaur,C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J. 1. Heard learned counsel for the petitioners, Shri Gopal Chand Saxena, learned Standing Counsel for the State-respondents, Mrs. Akanksha Gaur, learned counsel appearing for respondent nos. 2 and 3, and Shri Pranjal Mehrotra, learned counsel appearing for respondent no. 1. 2. By means of the present writ petition, the petitioners have approached this Court seeking a direction to the respondent authorities to ensure disbursement of compensation in respect of the acquired land bearing Khata No. 54, Khasra No. 1111, admeasuring 0.0081 hectare, situated in Village Bidanpur, Pargana Kada, Tehsil Sirathu, District Kaushambi, which was acquired under the provisions of the National Highways Act, 1956. 3. Learned counsel for the petitioners submits that the land in question was duly acquired under the National Highways Act, and the petitioners' holding formed part of the said acquisition. It is further submitted that although the award has been declared, and in response to the notice dated 08.01.2022, the petitioners have already submitted all requisite documents to the competent authority, no payment of compensation has been made to them till date. 4. Considering the nature of relief sought and the submissions advanced, and in view of the admitted position that the award has been made, this Court is of the opinion that no useful purpose would be served in keeping the writ petition pending. 5. Accordingly, and with the consent of the learned counsel for the parties, the writ petition stands disposed of with the direction that respondent no. 5, i.e., the competent authority, shall ensure that the due and admissible compensation is disbursed to the petitioners within a period of two months from the date of production of a certified copy of this order. 6. It is further provided that in case there arises any legal impediment in disbursing the compensation directly to the petitioners, the competent authority shall take appropriate action strictly in accordance with law to ensure that the amount is released or deposited in terms of the statutory provisions applicable in such cases.
