The ground pleaded in grounds (II) is quoted herein below:- Page No.# 48/52 “...(II) For that, Section 14 of the Regulations was not shown by any of the parties to this Hon’ble Court wherein it envisages that the Deputy Commissioner/Land Conservator may be order prohibit establishment of any new village or erection or any new residential houses on any jhum land. It is provided that no order shall be made under this section which would prevent person having customary rights to the land from securing reasonable and adequate accommodation for themselves and their families. In the instant case, the Deputy Commissioner/Review Petitioner was empowered by Section 14 of the Regulation, 1947 to issue the public notice dated 29.03.2021. It was made clear in the said notice dated 29.03.2021 that rempant construction of semi- permanent and permanent dwelling houses and other structures has been notices in the hill side. Further it was observed in the said notice that such purposeless structure have been built with a malafide intention of drawing excess land compensation amount in case of widening of highway in the said route. Thus, it is clear from a perusal of Section 14 of the Regulations, 1947 that Deputy Commissioner/Review Petitioner was well within his rights to issue the said public notice dated 29.03.2021. Further, the constructions were made in excess of their reasonable and adequate accommodation for themselves and their families. In that view of the matter, the impugned Judgment and Order dated 14.08.2024 is required to be reviewed”. 4. Per contra, Ms. N. Danggen, learned counsel for the respondents/writ petitioners referring to Section 14 of the Regulation, 1947, argues that such provision is relatable to Section 10 of the Regulation, 1947 and therefore, the ground sought for cannot be termed as a ground of review inasmuch as this Court had elaborately dealt with the issue at paragraph 13 of the judgment under review. 5. This Court has given anxious consideration to the submissions advanced by the learned counsel for the parties. Also perused the material available on record. Page No.# 49/52 6. This Court by the judgment under review categorically held at paragraph 13 that the notice dated 29.03.2021 was issued on the request of the Commanding Officer, BRO and not for any other reason and on the said date, the land acquisition process was not even initiated and it was initiated only on 24.05.2022. In the aforesaid context and in the admitted position that land in question was acquired under Section 10 of the Regulation 1947, this Court will have to read Section 14 of the Regulation, 1947. 7. Section 10 of the Regulation, 1947, empowers the government to acquire any Jhum land required for public purposes and the said provision further prescribes that though no formal acquisition proceedings shall be necessary but an opportunity shall be given to those having rights in the land to show cause against such acquisition and reasonable compensation shall be paid for all land required under this Section. At the same time, Section 14 of the Regulation, 1947, empowers Land Conservator to prohibit establishment of new village or any new residential house or any Jhum land. 8. In the case in hand, it is not disputed that the order dated 29.03.2021 was issued on the request of the Commanding Officer, BRO and not for any other reason. The fact also remains that on the date of issuance of notice 29.03.2021, no acquisition process was initiated under Section 10 of the Regulation, 1947, and it was issued on 24.05.2022 only. This Court, thus, held that though the Deputy Commissioner, in the exigencies of administration can pass such a restraint order, in a given case, when he is authorised under law to do so. This Court is still of the opinion that in the given facts, the order dated 29.03.2021, cannot be made relatable to Section 14 of the Regulation, 1947 more particularly, the land was admittedly acquired for construction of road by B.R.O. not for any purpose under the Regulation, 1947. At the same time, the Page No.# 50/52 notice dated 29.03.2021 was not issued to implement and/or achieve any object under the Regulation, 1947 but at the request of the Commanding Officer, B.R.O. Therefore, by stress of no imagination it can be said that it was issued in exercise of power under Section 14 of the Regulation, 1947. The fact also remains that this court was dealing with an acquisition process on a date, when the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 Act, was already in force and the law made applicable in the present case dates back to 1947 enacted to safeguard and regulate the rights of tribes indigenous to the Balipara/Tirap/Sadiya Frontier Tracts to Jhum land. 9. When the impugned notice dated 29.03.2021 was issued admittedly on the request of Commanding Officer, B.R.O and there is no disclosure that it was issued in exercise of power under Section 14 of the Regulation, 1947 and it can be said that the notice dated 23.09.2021 was issued in exercise of power under Section 14 of the Regulation, 1947. The fact also remains that the impugned notice dated 29.03.2021 is in no way relatable for safeguarding or regulating right of tribes to Jhum land rather, was issued to protect the right of B.R.O., who was intending to acquire land. 10. The law is well settled that a review application is maintainable on discovery of new and important matters or evidence which, even after exercise of due diligence, was not within the knowledge of the applicant or could not be produced by him when the decree was passed, or the order was made. Secondly, such a review application shall be maintainable on account of such mistake or error apparent on the face of the record or for any other sufficient reason. 11. The material error, to exercise the power of review must be manifest on Page No.# 51/52 the face of the order and would result in a miscarriage of justice or undermine its soundness. 12. The error apparent on the face of the record shall mean an error that is self-evident and no process of reasoning is required to detect such error. Therefore, when an error is not self-evident and is required to be detected by the process of reasoning, such error cannot be described as an error apparent on the face of the record. 13. It is also equally well settled that while exercising review jurisdiction, a Court cannot appreciate the evidence to arrive at a different conclusion, even when two views are possible in a matter. 14. Now, coming to the case in hand, a bare perusal of the ground of review pleaded and urged by the learned senior counsel leads to an unhesitant conclusion in the mind of this Court that the present review is nothing but an appeal in disguise inasmuch as this Court in the judgment under review at paragraph 13 elaborately dealt with the issue as recorded herein above and considered the right of the petitioner under Article 300(A) of the constriction of India. 15. Accordingly, this Court is of the view that the review petitioner has urged to re-appreciate the facts to arrive at a different conclusion as to what has already been held. Therefore, this Court is of the unhesitant view that this review petition lacks merit and accordingly, the same stands dismissed. Parties to bear their own cost.
