After arguing the matter, when confronted with the query as to whether the dispute which has been referred to the arbitrator u/s 70 of the U.P. Cooperative Societies Act, 1965, is cognizable by way of arbitration or not, learned counsel for the petitioner submitted that the present petition may be dismissed with the liberty to the petitioner to approach the appropriate forum seeking relief of cancellation of sale deed executed by respondent no. 2 in favour of respondent no. 3. 2. Accordingly, the writ petition is dismissed with the aforesaid liberty. 3. In case the petitioner avails the appropriate remedy, the order impugned will not come in the way of the petitioner in seeking appropriate remedy.
