Learned AGA takes notice for respondent Nos. 1 to 4. 2. This petition is filed by the petitioner who is the mother of twin children who are in conflict with law. The prayer made in this petition is as under:- - 3 - HC-KAR NC: 2025:KHC:54742 WP No. 38800 of 2025 "Wherefore, under these facts and circumstances of the case, it is most respectfully prayed before this Honourable court that this Honourable court may kindly be pleased to a. Issue a writ of Mandamus or any other appropriate writ directing the respondent 02 to remand the sons of the petitioner as she is the parent/guardian to her custody on her undertaking to produce (CICL) before the respondent No. 02 as and when required. b. Hold that the detention of the (CICL) from 17/12/2025 was illegal and without jurisdiction as per the acknowledged requisitions dated 19/12/2025 produced at Annexure B, D & F. c. Direct the respondent No. 02 to pay the compensation of sum of rupees five lakhs (Rs.5,00,000/-) each to the (CICL) for illegally detaining them. d. Quash the remand order dated 17/12/2025 passed by the Juvenile Justice Board, Udupi District, (since no copy is given to the petitioner by the respondent No. 02 unable to produce the same). - 4 - HC-KAR NC: 2025:KHC:54742 WP No. 38800 of 2025 3. During the course of the petition, learned counsel for the petitioner submits that he may be permitted to withdraw this petition and liberty be reserved to him to approach the Juvenile Justice Board to make necessary application seeking bail and release. If such an application is made, the Board shall consider the application in accordance with law and pass suitable orders considering the age of the children. 4. Per contra, learned AGA representing the respondent submits that the bail petition was filed by the petitioner, came to be rejected by the Board on 17.12.2025. Therefore, nothing survives in this petition as it is for the petitioner to approach the Board and make a fresh application, if so advised and warranted. The same could be considered in accordance with law. 5. Having heard learned counsel for both parties, this Court deems it appropriate to grant leave to the petitioner to withdraw this petition, reserving liberty to her - 5 - HC-KAR NC: 2025:KHC:54742 WP No. 38800 of 2025 to approach the Juvenile Justice Board, make necessary application for release / bail. On such application being filed, the Board shall consider the same and pass suitable orders in accordance with law.
