JUSTICE MOHAMMAD NAWAZ ORAL ORDER FIR is registered against the petitioner in Crime No.212/2025 of Doddapete Police Station, Shivamogga, for the offence punishable under Section 69 of BNS, 2023. 2. This petition is preferred under section 483 of BNSS, 2023 to enlarge the petitioner on bail. 3. In the complaint lodged by the victim, she has alleged that the petitioner is her distant relative and about one year prior, he approached her stating that he is in love with her and will marry her. Thereafter, they used to meet often. It is alleged that on 04.09.2024, petitioner took her to Shivamogga and in a lodge, committed sexual intercourse with her, with a promise of marriage and thereafter, repeated the said act several times. As per complaint averments, petitioner and the complainant are known to each other. Petitioner is a distant relative of the victim. It is alleged that on 04.09.2024, petitioner with a promise of marriage committed forcible sexual intercourse with the petitioner in a lodge and repeated the said act on several occasions. 5. The complaint is lodged on 23.06.2025. The complainant/victim is a major aged about 22 years. The ingredients of the offence alleged have to established during trial. Petitioner is in judicial custody from 23.06.2025. In the facts and circumstances, without expressing any view on the merits of the case, relief sought in the petition can be granted by imposing conditions. Accordingly, the following: ORDER i. Petition is allowed. ii. Petitioner/accused in Crime No.212/2025 of Doddapete Police Station, Shivamogga, shall be enlarged on bail, subject to following conditions: - 4 - HC-KAR NC: 2025:KHC:36935 CRL.P No. 12079 of 2025 1. He shall execute a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly influence or threaten the victim or tamper with the prosecution witnesses. 4. He shall not indulge himself in committing any offence. 5. He shall appear before the trial Court on every date of hearing without fail. Violation of any of the above condition shall result in cancellation of bail.
