Order 17/12/2025
1. In both the writ petitions, challenge is to the interim orders even dated 05.12.2025, passed by Central Administrative Tribunal, Jaipur, to the extent of not considering the prayer of interim relief as prayed by the petitioners in their respective OAs.
2. For ready reference the order impugned dated 05.12.2025, which is ad verbatim in both the petitions, is being reproduced hereunder:-
"Heard. Issue notices to the respondents. Shri Manu Bhargava, Sr.C.G.S.C., appeared on advance instructions and accepts notices on behalf of the respondents. He prays for time to file reply."
3. From a bare perusal of the impugned order(s), we find that the Tribunal have not extended any heed either to accept or deny the interim prayer made by the writ petitioners and the order suffers from non-application of mind in this respect.
[2025:RJ-JP:50930-DB] (4 of 5) [CW-19570/2025]
4.
Learned counsel for the petitioners has tried to make out a prima facie case for grant of interim relief, stating inter alia that few juniors to the present petitioners have been included in the eligibility list to appear and participate in the process of promotion to the post of Goods Train Manager, under the Notification dated 30.07.2025 of NWR and to appear in the Computer Based Test (CBT) and in the light of Master Circular No.31, more particularly as per the Note appended to Clause 7 dealing with the selection procedure, petitioners are also entitled to appear in the CBT, hence interim order for allowing petitioners in CBT provisionally, be granted.
5. For ready reference relevant Note of Master Circular is being reproduced hereunder:-
"1. If by virtue of operation of the procedure laid down in (a) to (d) above, a junior is eligible for promotion to the relevant next higher grade, his senior also will be eligible for such promotion even though he might not have put in a total of two years service in the immediate lower grade."
6. Be that as it may, we are not inclined to consider the interim prayer of petitioners on merits and leave it open, to consider the same on merits, by the Tribunal. In view of the fact that the exam of CBT is likely to be scheduled in the month of January, 2026, it is expected that the Tribunal shall consider the prayer of interim relief, based on the material available before it, on merits as expeditiously as possible and preferably within a period of 15 working days from the date of receipt of a copy of this order, if possible.
[2025:RJ-JP:50930-DB] (5 of 5) [CW-19570/2025]
7. With the above observations, both the writ petitions stand
disposed of.
