Order 29/10/2025
1. By way of filing this criminal writ petition, the petitioners are seeking directions to the official-respondents to provide adequate security and protection to them on the ground that they are facing grave threat to their life and liberty at the hands of private respondents.
2.
Learned counsel for the petitioners submits that prior to approaching this Court, the petitioners have approached the State Police officials as well as the Nodal Officer for the aforesaid prayer by way of filing different reprsentations on 29.03.2025 and
08.04.2025. Learned counsel submtis that inspite of passing suitable time, till date no orders have been passed, hence, interference of this Court is warranted.
3. Per contra, learned Public Prosecutor as well as learned counsel for the complainant oppose the prayer made by learned counsel for the petitioners.
(3 of 3) [CRLW-504/2025]
4. Article 21 of the Constitution of India provides for right to life and personal liberty under the ambit of fundamental rights and any threat to the same amounts to violation of the same.
5. Looking to the fact that the petitioners have already submitted appropriate representations seeking protection before the Nodal Officer, it is expected from the Nodal Officer to pass appropriate orders in terms of the directions issued by the co- ordinate Bench of this Court in the case of Suman Meena vs. State of Rajasthan (S.B. Criminal Writ Petition No.792/2024) and if necessitated, may pass necessary orders to provide adequate security and protection to the petitioners.
6. It is made clear that any observation made in this order or made by the Nodal Officer would not affect any criminal and civil proceedings initiated against either of the parties.
7. With the aforesaid observations, the instant criminal writ petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of.
