ISSUE A WRIT OF MANDAMUS DIRECTING THE RESPONDENTS TO CONSIDER THE REPRESENTATIONS DATED 19.06.2025 AND 29.07.2025 VIDE ANNEXURE C AND D. FORTHWITH RELEASE THE OUTSTANDING BILL AMOUNT OF RS. 61,88,500/- AND RS 23,45,876/- TO THE PETITIONER. THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs; a. "Issue a Writ of Mandamus directing the Respondents to consider the representations dated 19.06.2025 and 29.07.2025 vide Annexure C and D. forthwith release the outstanding bill amount of Rs.61,88,500/- and Rs.23,45,876/- to the petitioner: b. Pass such other and further order(s) as this Hon'ble Court deems fit in the interests of justice and equity." 2. The short grievance of the petitioner is that the bills which have been submitted by the petitioner for having carried out works in pursuance of the work order issued by respondent No.3 to the petitioner had not been considered and as such representations - 3 - HC-KAR NC: 2025:KHC:43404 WP No. 31825 of 2025 dated 19.06.2025 and 29.07.2025 at Annexure-C and D have also not been considered and payment made. 3. Whenever any bills are submitted it is but required for tendering authority to consider the same and make payment of the due amounts or reject the bills within a reasonable period of time. Needless to say, if the bills are rejected reasons have to be accompanied by such order. 4. Neither having been done, I pass the following: ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondents to consider the bills raised by the petitioner along with supporting documents as also the representation at Annexure-C and D within a period of four weeks from date of receipt copy of this order. - 4 - HC-KAR NC: 2025:KHC:43404 WP No. 31825 of 2025 iii. It is made clear that this Court has not expressed any opinion on the entitlement for any payment by the petitioner. SD/- (SURAJ GOVINDARAJ) JUDGE SR List No.: 1 Sl No.: 41
