Neutral Citation No. - 2025:AHC:74901 Court No. - 47 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 14825 of 2025 Applicant :- Suraj Kumar Opposite Party :- State of U.P. Counsel for Applicant :- Brijesh Kumar Srivastava Counsel for Opposite Party :- G.A. Hon'ble Siddharth,J. Heard learned counsel for the applicant and learned A.G.A. for the State. There are allegations against the applicant of abetting the suicide of his wife. It is clear from the first information report that matrimonial dispute was pending between the applicant and the deceased for last three years. The deceased had lodged the case under Section 498-A I.P.C etc., against the applicant. After compromise between them, she had returned to her matrimonial home where she committed suicide.
Learned counsel for the applicant submits that the applicant and the victim married on 25.04.2012. The dispute took place on 30.01.2020. The demand of dowry after such a long time by the applicant does not appears to be credible. Because of strained relation-ship between the applicant and the victim, she committed suicide. The ingredients for constituting the offence of abetting the suicide are not made out against the applicant. He is in jail since07.02.2025 and has no criminal history to his credit. Learned AGA has opposed the prayer for bail but could not dispute the above
submissions. No. 5191 of 2021 and considering 5-6 times overcrowding in jails over and above their capacity by the under trials and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail.
