Mr. Abhinav Sharma, learned counsel for the appellant, submits that for quite some time in the past neither the appellant noranyone on his behalf has contacted his office. And, thus, it appears that appellant is not willing to pursue the matter any further. To this, learned counsel for the respondents submits that let the appeal be disposed of as having been rendered infructuous. However, in case any dispute/cause of action/interests still survives, liberty be granted to the appellant to move an appropriate application for restoration of the appealand its decision on merits. In the wake of above and in terms of statement made by learned counsel for the parties, the appeal is disposed of as having been rendered infructuous, with liberty as prayed for.
