Hon'ble Prashant Kumar,J. 1. Heard Sri Ram Prakash Shukla, learned counsel for the applicants, learned Additional Government Advocate for the State and perused the record. 2. The present application under Section 528 BNSS has been filed by the applicants praying for quashing of the bailable warrant dated 20.02.2025 as well as entire proceedings of Case No. 2617 of 2023 (Crime No. 0376 of 2022) (State vs. Samar Bahadur Patel and others), under section 342, 376, 120-B I.P.C., Police Station Madiyahu, District Jaunpur, pending in the court of ACJM, First Court no. 12, Jaunpur. 3. The Court does not see any illegality, impropriety and incorrectness in the impugned order under challenge and also there seem to be no abuse of court's process. There is no good ground to interfere in the same, therefore, the prayer for quashing of the impugned order is refused. 4. However, a request has been made that the applicant wants to surrender in the court below and applies for bail and for that some protective direction may be issued. 5. In view of the facts and circumstances of the case it is directed that in case the applicant surrenders within three weeks from today and applies for bail, the same shall be considered and decided in accordance with law. 6.
