The Petitioner is working as an outsourcing lecturer in 2. K.G.B.V Vidhyalayam, Vepadu Mandal, Vizianagaram District since 2015. The Petitioner had obtained a B.P.Ed from Vikram Simhapuri University in the year 2018. In the examination conducted pursuant to the DSC Notification, 2025, the Petitioner had secured a normalized score of 77 and earned a place in the merit list with rank of 46 under the BC-D Category. Thereafter, she was called for certificate verification on 28.08.2025 at Vizianagaram and in the certificate verification she had submitted all the documents required. Thereupon, the Petitioner’s appointment was rejected on the ground that she secured B.P.Ed degree while working as outsource lecturers in K.G.B.V. Vidyalayam. Hence, the present Writ Petition. 3 3. Sri G. Ramachandra Rao, learned Government Pleader would submit that the rejection of the candidature of Petitioner is valid as she could not have pursued B.P.Ed while working Lecturer. as Having heard the respective counsel, there is no dispute to the fact that the Petitioner secured a B.P.Ed qualification from Vikram Simhapuri University and is entitled to be appointed on the score that she has obtained in the DSC Examinations, 2025. The rejection of the candidature of the Petitioner on account of not obtaining a ‘No Objection Certificate’ from the A.P. Model School where she was working on an outsourcing basis may not be a serious disqualification. More so when she is only working on an outsourcing basis. The permission would at best be required for regular employees. Therefore, this Court is of the opinion that as long as the Petitioner has the requisite qualification for being appointed as School Assistant as per the DSC Notification, 2025, the candidature of the Petitioner cannot be rejected. Hence, the present Writ Petition is disposed of with the following directions: 4. 4 (i) The Respondent Authorities are- directed to consider the case of the Petitioner for recruitment to the post of School Assistant (Physical Education) in the light of her qualifications and marks secured in the DSC examination, 2025.
