Yarraguntla.Koteswara Rao,Standing Counsel For Zilla Praja Parishads,Mandal Praja Parishads and Gra The Court made the following order: The short grievance of the petitioners is non removal of the encroachments made in the Panchayat Drain/Canal situated in both sides of the Donka road in Sy.No.411/1 to 5 of Old Sri Mohd. Imtiaz Nagar(New Bommasani Nagar) of Urmila Nagar, Gollapudi village, Vijayawada Rural, Krishna District despite making several representations in that regard. 2. Heard Sri Venkat Challa, learned counsel for the petitioners, Sri Y.Koteswara Rao, learned Standing counsel for Gram Panchayat and Sri Chandrasekhar, learned Assistant government pleader for Revenue. 3. Sri Y.Koteswara Rao, learned Standing counsel for Gram Panchayat and Sri Chandrasekhar, learned Assistant Government Pleader for Revenue collectively submitted that there were no encroachments made in the subject survey numbers as alleged by the petitioners but there are encroachments in R.S.Nos.416 & 417 which is the pathway to petitioners lands and they have sufficient way to enter into their patta lands. However, the authorities have addressed a letter dated 17.04.2025 to the Gram Panchayat concerned to take immediate action for removal of the said encroachments and they will take steps in accordance with law. 4. In view of the above submissions that the authorities have an intention to take steps for removal of encroachments in accordance with law, instead of keeping this writ petition pending, this Court is inclined to dispose of the writ petition with the following directions: <The 5th respondent-Gram Panchayat shall take steps for removal of encroachments, if any made in the Panchayat Drain/Canal situated in both sides of the Donka road in Sy.No.411/1 to 5 and also in R.S.Nos.416 & 417 of Old Sri Mohd. Imtiaz Nagar (New Bommasani Nagar) of Urmila Nagar, Gollapudi village, Vijayawada Rural, Krishna District, in accordance with law by issuing show cause notices to all the concerned parties inviting explanation by giving reasonable time and to pass a reasoned order after providing an opportunity of being heard and communicate the same to all the parties concerned in accordance with law within three(03) months from the date of receipt of copy of this order=.
