The learned Standing counsel appearing for the respondent submits that the cause in the writ petition does not survive any further. It is further submitted by the learned Standing counsel that the petitioner had attained the age of 53 years and sought a declaration from this Court directing the respondents to permit the petitioner to be promoted with effect from 24.02.2013. 2 3. This Court granted an interim direction on 31.12.2014, directing the respondents to consider the case of the petitioner for promotion, notwithstanding the imposition of the punishment of censure, subject to his eligibility and in accordance with the rules. 4. It is further submitted by the learned Standing counsel that the petitioner has also attained the age of superannuation during the pendency of the writ petition. It is submitted that the petitioner was appointed as Lineman with effect from 12.08.2002, and his claim for monetary benefits and promotion with effect from 23.09.2011 was not considered in accordance with the regularization under the APSEB Rules. Considering the fact that the petitioner has attained the age of superannuation, no further orders are required in this writ petition. 5. Accordingly, the writ petition is disposed off in terms of the interim orders granted by this Court. There shall be no order as to costs.
