The present petition is preferred against the impugned order dated 08/01/2025 (Annexure P/1) whereby the services of the petitioner has been transferred from Veterinary Hospital District Bemetara to Animal Dispensary, Kardega, District Jashpur which is 450 kms from the present place of posting and also without any complaint or administrative exigencies. On 11/11/2024 the petitioner has been selected for training of animal computation for the District Bemetara and the responsibilities of supervisor has also been handed over to him. On 07/01/2025, the Director (respondent no.3) has written a letter to all Collectors as well as Chief Executive Officers of every District, Panchayat for completion of animal computation till February 2025. In the letter, it is also observed that the officers/employees, who are attached with the work of animal computation, they may not be allotted further work, so that the work of animal computation would not be affected. The petitioner is suffering from mid-term transfer as his son is studying in class 9th at Jawahar Navodaya Vidyalaya, Kusmi, Bemetara and also the petitioner has to look after his old aged parents and they are regularly taking treatment from Bemetara as well as Baloda Bazar. Hence this petition. 2. Following reliefs have been sought in this petition: “10.1 That, this Hon'ble Court may kindly be pleased to set-aside/quashed the impugned order dated 08/01/2025 issued by respondent no.1 so far it relates to the petitioner and further be pleased to direct the respondent authorities to allow the petitioner to continue at his present place of posting. 3 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.” 3. Learned counsel appearing for the petitioner submits that the petitioner has been transferred, however, it has not been considered by the respondents authorities that the petitioner has been engaged in 21st Livestock Census Scheme being run by the Central Government wherein the petitioner is having separate log and the password for the specific area in mobile application which is not transferable and the said work is to be concluded upto February, 2025, as such the transfer order is required to be quashed and appropriate order is required to be passed by the respondents authorities. Since the only ground which has been raised by the petitioner which is arguable in this case is that since the petitioner is engaged in the livestock census work, as such the order of his transfer, in my opinion, should be kept in abeyance till the census work comes to an end. For this, when it was inquired from the State Counsel, it was replied that hardly it will take time upto 28.2.2025 and as such it is directed that the order of transfer passed against the petitioner may be kept in abeyance till 10.3.2025 and the petitioner is directed to join his transferred place by 17.3.2025. 4.
