THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 870 of 2025
ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused No.5, seeking regular bail, in Crime No.66 of 2024 of Mothugudem Police Station, East Godavari District.

Case of the prosecution, in brief, is that on 08.09.2024, the Sub- Inspector of Police along with his staff and mediators rushed to opposite of Mothugudem Police Station, and caught the accused in possession of 110Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report.
3. Heard. Perused the record.

Learned counsel for the Petitioner submits that similarly placed persons i.e. A2 and A6 have obtained regular bail from a Co-ordinate Bench of this Court in the very same crime, vide order in Crl.P.No.661 of 2025, dated 24.03.2025.
5. Learned Assistant Public Prosecutor would fairly submit that the case of the present petitioner is also on the same footing as of A2 and A6, who were already granted bail by this Court. Learned Assistant Public Prosecutor would further submit that the Court may pass appropriate Orders.

6. In that view of the matter, considering the submissions made, since A2 and A6 who are on the same footing as of Petitioner/A5 were released on bail, this Court is inclined to grant bail to petitioner herein on the following conditions.
(i) The petitioner/A5 shall be released on executing a personal bond for Rs.50,000/- (Rupees fifty thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Rampachodavaram.
(ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a fortnight i.e., on 1st and 15th of every month between 10.00 AM and 01.00 PM., for a period of three (3) months.
(iii) The petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses.
7. Accordingly, the Criminal Petition is allowed.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
