A JAYANTHI 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 22190 OF 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased issue a writ, order or direction more particularly one in the nature of a writ of mandamus Directing the respondents to initiate a fair, impartial and independent investigation into the incident of custodial torture of petitioner and consequently direct the respondent to initiate criminal proceedings against the respondent Nos.5 to 8 and pass such other order or orders as this Hon’ble Court deems fit and proper in the interest of Justice, equity and to safeguard the fundamental rights guaranteed under Article 21 and 22 of the Constitution of India and to pass…” 2. Heard Sri S.Rama Lakshmana Reddy, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned Assistant Government Pleader for Home placed on record the proceedings issued by the respondent No.2-Director General of Police to the Superintendent of Police, Palnadu District, directing him to enquire into the matter. The Superintendent of Police, Palndau District, in turn, entrusted that work to the SDPO, Gurazala to enquire into the matter. However, due to engagement in urgent and unavoidable official duties from 11.09.2025 onwards, the enquiry could not be completed within the time stipulated. 4. Recording the same, the Writ Petition is disposed of. However, the Police are directed to conclude the enquiry, and the Superintendent of Police, Palnadu District, is directed to ensure that the enquiry is completed within a period of three (03) months from the date of receipt of a copy of this order. 4 The result of the enquiry and the action taken report against the erring individuals, if any are found in the enquiry, shall be communicated to the petitioner. There shall be no order as to costs.
