1. State of Rajasthan through P.P.
2. S.H.O. Police Station Bonli, District Sawaimadhopur, Rajasthan. 3. Pukhraj S/o Goverdhan, R/o Village Bagdoli, Bagroll, P.S. Bonli, District Sawaimadhopur. ----Respondents For Petitioner(s) : Mr. Vikas Saini For Respondent(s) : Mr. Vivek Choudhary, PP Mr. Ashindra Gautam HON'BLE MR. JUSTICE ANAND SHARMA Order 06/10/2025
1. Petitioner has invoked inherent jurisdiction of this Court under Section 482 Cr.P.C. for quashing of F.I.R. No.199/2018 lodged at Police Station Bonli, Sawai Madhopur, under Sections 363 & 366 IPC against the petitioner. 2. Bare perusal of FIR would reveal that informant Pukhraj S/o Gordhan levelled allegations that his daughter Smt. Lali was abducted by the petitioner. 3. This Court vide order dated 13.07.2018, directed the Registrar (Judicial) to record the statements of Smt. Lali, the alleged victim. Accordingly, statements of victim-Smt. Lali were
[2025:RJ-JP:40357] (2 of 2) [CRLMP-3825/2018] recorded by the Registrar (Judicial) on 13.07.2018 itself which are as under: **'kiFk iwoZd c;ku djrh gwa fd eSa yM~Mw yky dks cgqr fnuksa ls tkurh gwaA esjh yM~Mw yky ls eqykdkr xkao esa gh gqbZ FkhA eSa yM~Mw yky ls 'kknh djuk pkgrh FkhA eSaus bl ckjs esa vius ?kjokyksa dks crk;k Fkk ysfdu esjs ?kj okyksa us bl 'kknh ds fy, euk dj fn;kA blfy, eSa ?kj ij crkdj fd eSa yM~Mw yky ds ikl tk jgh gwa vkSj eSa ?kj ls fudy xbZA blds ckn eSa yM~Mw yky ds ikl pyh xbZ vkSj ogka ls ge xkft;kckn pys x, vkSj ogka ij vk;Z lekt efUnj esa 'kknh dj yhA 'kknh ds ckn ls ge lkFk lkFk py jgs gSaA yM~Mw yky ls 'kknh eSaus viuh bPNk ls ,oa fcuk fdlh ncko ds dh gSA esjk fdlh us dksbZ vigj.k ugha fd;k gSA esjs firk th us tks fjiksVZ ntZ djok;h gS fcYdqy >waBh gSA eSa vc yM~Mw yky ds lkFk gh jguk pkgrh gwaA eq>s vkSj dqN ugha dguk gSA**

In view of the above statements made by the victim- Smt. Lali that she has performed marriage with the petitioner and has been living a happy married life with him and even a certificate of Registration of Marriage declaring that the marriage was solemnised on 22.06.2018 has been placed on record by the petitioner, this Court finds that under the circumstances, prosecuting the petitioner pursuant to the impugned FIR would be a futile exercise and would also cause miscarriage of justice to the petitioner. Hence, this Court deems it just and proper, in the interest of justice to quash and set aside F.I.R. No.199/2018 lodged at Police Station Bonli, Sawai Madhopur. 5. Accordingly, the Criminal Miscellaneous Petition stands allowed. (ANAND SHARMA),J DAKSH/46
