The appellant has filed the instant appeal under Section 19 (1) of the Family Courts Act, 1984 against the impugned judgment & decree dated 26.04.2025 passed in Civil Suit No. 567/2025 passed by the learned Additional Principal Judge, Family Court, Janjgir, Distt. - Janjgir-Champa (C.G.), whereby the application under Section 20 (3) of the Hindu Adoption and Maintenance Act, 1956 for claiming of expenses for respondent is partly allowed. During the pendency of appeal, both the parties agreed for amicable settlement and vide order dated 01.09.2025, the matter was referred to Mediation Centre of this Court and both parties have settled their dispute before the Mediation Centre on 17.09.2025, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 17.09.2025, which was duly signed by them. 3. Operative paras of the settlement agreement dated 17.09.2025 are as under:- “माननीय उ यायालय के आदेश दनांक 01.09.2025 के पपालन म यह कण के FA(MAT) No. 188/2025 (Halsuram Sahu vs. Ku. Tanya) म मयथता हेतु ेत कया गया दनांक 17.09. 2025 को मयथता कया संप" कया। मयथता कया के अनु%प प&कागण के मय एकल एवं संयु) स* मयथता के + छ-ीसग. उ यायालय, /लासपु म दनांक 01.09.2025 एवं 17.09.2025 को उभयप& के मय आयो12त कया गया। आ2 दनांक को उभयप& अं3तम नण4य की 6थ3त म पहुँच चुके है औ उनके मय ववाद वे;छापूव4क पूण4 सहम3त के साथ सभी ववादो प नपटाा क एवं अपने आपसी वैचाक मदमेद एवं ववाद को ख?म क वयंम के ववेक से नीचे दये गये शत@ प सहमत है :- 1. अनावेदक Aाा अनावेदका को एकमुBत 1,02,000/- (एक लाख दो ह2ा %पये मा*) दो कBतC म अदा केगा 12सकी थम कBत आ2 दनांक 17.09.2025 को छ-ीसग. उ यायलय के मयथता के + मे मयथ के सम& 3 52,000/- (/ावन ह2ा %पये मा*) आवेदक Dी हुलसाम साहू के Aाा अनावेदका कु . ता या को नगद अदा क दया गया है व दुसी कBत माननीय यायालय के सम& 17.10.2025 तक 50,000/- (पचास ह2ा %पये मा*) को अदा कगे। 2. आवेदक Dी हुलसाम साहू Aाा अनावेदका के वEF कण क. FA(MAT) No. 188/2025 (Halsuram Sahu vs. Ku. Tanya) को अं3तम कBत अदा कने के पGात् वापस ले Iलया 2ाएगा। उभयप& इस समझौता प* की शत@ से सहमत हM एवं पालन के Iलए कट/F हM समझौता प* म दी गई शत@ को उ हCने अपनी वयं की वे;छापूव4क सहम3त एवं /ना कसी द/ाव, भय एवं लालच के वीका कया गया है उभयप& ने इस समझौता प* की शत@ को प.ने व समझने के पGात अपनी वतं* सहम3त से पप एक-दूसे की उप6थ3त म हता& क नOपादत कया। /लासपु (छ-ीसग.) Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicably resolved the dispute before the Mediation Centre of this Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 17.09.2025. 5. We have heard learned counsel for the respective parties. 4 6. It is pertinent to mention here that The appellant has already paid the total settled amount of Rs. 1,02,000/- (Rupees One Lakh Two Thousand only) in two installments as agreed between the parties. The first installment of Rs. 52,000/- (Rupees Fifty-Two Thousand only) was paid in cash on 17.09.2025 by the applicant - Hulsaram Sahu to the respondent - Ku. Tanya before the learned Mediator at the Mediation Centre and the second installment of Rs. 50,000/- (Rupees Fifty Thousand only) has also been duly paid before the Court today i.e. 27.10.2025. 7. In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 17.09.2025, the present appeal is disposed of in terms of the said agreement, the terms of the settlement agreement dated 17.09.2025, will form part of this judgment/decree. 8. Accordingly, the appeal is disposed of on the ground of compromise arrived at between the parties dated 17.09.2025. 9. Let a decree be drawn accordingly.
