Respondent/Complainant Petition under Section Sec.528 of BNSS praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to relax and modify the conditions No. 18 (i), (iv) & (v) imposed by Common
Order, dt.12.9.2025 in CRL.P.Nos.8787/2025 & 8789/2025, Pending disposal of CRLP No.8789 of 2025, on the file of the High Court. The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt of notice in the case).
COMMON ORDER: Heard Sri P.Veera Reddy, learned Senior Counsel for the Petitioners and the learned Assistant Public Prosecutor. Considering the
facts and circumstances of the case, these Interlocutory Applications are required to be disposed of by partly modifying the conditions inasmuch as condition No.1 has been relaxed and complied with. With regard to condition No.4 at paragraph No.18 of the common
order dated 12.09.2025 in Crl.P.Nos.8787 & 8789 of 2025 is hereby modified as follows:
“4. Petitioners shall appear before the Station House Officer concerned for a period of three (03) months or till filing of the charge sheet, whichever is earlier. ”
With regard to condition No.5 at paragraph No.18 of the common
order dated 12.09.2025 in Crl.P.Nos.8787 & 8789 of 2025 is hereby modified as follows:
5. Petitioners shall not leave the limits of the State of Andhra Pradesh, Telangana and Tamil Nadu without the express permission from the Station House Officer Concerned till filing of the charge sheet.” tt Accordingly, I.A.No.1 of 2025 in Crl.P.No.8787 of 2025 and I.A.No.2 of 2025 in Crl.P.No.8789 of 2025 are partly allowed.
