Neutral Citation No. - 2025:AHC:65688-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 8157 of 2025 Petitioner :- Suman Srivastava Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Sharad Kumar Srivastava Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Anil Kumar-X,J. 1. Heard learned counsel for the petitioner as well as the learned Additional Government Advocate representing the State-respondents at length. 2. The relief sought in this petition is for quashing of the impugned notice dated 28.03.2025 to petitioner for investigation/Technical Eamination of the Truck No.U.P.-78-JT-1746 alongwith driver pursuant to the FIR dated 28.03.2025 having Case Crime No.0129 of 2025 under Section 281, 106(1) BNS 2023, Police Station Kalyanpur, District Kanpur Nagar. Further prayer has been made not to arrest the petitioner in the aforesaid case. 3. We have the occasion to peruse the record. Perusal of the impugned first information report prima facie reveals commission of cognizable offence. The Investigating Officer had sent notice under Section 94 of BNS 2023 for investigation/Technical Examination of the Truck No.U.P.-78-JT-1746, which belongs to the petitioner. 4. Considering the facts and circumstances, we do not find any reason to interfere in the on-going investigation, which warrant interference. 5. The writ petition is devoid of merits and accordingly, the same is dismissed. (Anil Kumar-X,J.) (Mahesh Chandra Tripathi,J.) Order Date :- 28.4.2025 A.
