1. Heard Mr.Aman Pandey, learned counsel for the petitioners as well as Mr.S.S.Baghel, learned Deputy Government Advocate appearing for respondent No.1/State.
2. The present petition has been filed by the petitioner under Section 482 of the CrPC with the following prayers :-
“It is, therefore, prayed that this Hon'ble Court may kindly be pleased to allow the present petition by setting aside chargesheet bearing No. 86 of 2023 dated 07.09.2023 pending before the Civil Judge and Magistrate Court, Durg, arising out of FIR bearing No. 80 of 2023 registered at PS Mahila Thana, District Durg (CG) for offences punishable under section 498A r/w 34 of IPC and grant any other relief to which the petitioners are entitled to.”

It transpires from the order-sheet that there is no interim order passed by learned Single Bench of this Court on 31.10.2023 and further no notice was issued to respondent No.2 in the present case. Though the dispute is matrimonial in nature, but the husband who is co-accused in the present case has not been made as party and the petitioners are family members.

Learned counsel for the petitioners states that the present petition
3 may be dismissed as withdrawn with liberty to file afresh if the matter still survives and trial has not been concluded.
