2 station Urla, District Raipur (CG) for the offence punishable under Section 74 & 76 of the BNS and Section 10 of the Protection of Children from Sexual Offences Act, 2012. 2. Asper the prosecution story, on 03.07.2025, mother of the prosecutrix lodged a report at Police Station Urla alleging that on 02.07.2025, when her minor daughter aged about 6 years, was playing near the gate of their house, the applicant came there, pulled down her clothing and made lie down near the gate. At that time, a neighbour, who witnessed the incident, intermediately intervened and slapped the applicant. 3. Counsel for the applicant submits that there was some previous dispute between them and therefore he has been implicated in a false case. He further submits that the applicant is in jail since 04.07.2025, the charge sheet has been filed and the trial is likely to take some time, he is ready and willing to comply with any of the conditions which may be imposed upon him and thus, it is submitted that the application be allowed and the applicant be released on bail. 4. Learned counsel for the respondent/State, on the other hand,has opposed the bail application. 5. Notice has been duly served upon the brother of the victim but none appeared. Ms.Anjali Pradhan, Advocate, present in the Court is requested to assist the Court as Amicus Curae on behalf of the victim. 6. Heard counsel for the parties and perused the record. 7.
On due consideration of the rival submissions and the fact that the applicant made an attempt to commit the offence of aggravated
3 sexual assault with the victim who was a minor thus, looking to the nature of the offence, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 483 of the BNSS is hereby rejected. Sd/- (Arvind Kumar Verma) Judge
