2. Petitioner has been made accused in connection with Garu P.S. Case No. 30 of 2024 for the offences registered under sections 65(1), 55 and 115(2) of the Bharatiya Nyaya Sanhita and section 6 & 17 of the POCSO Act, 2023, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, POCSO, Latehar.
3. Co-accused Jitu Singh is alleged to have forcibly established physical relationship with the Informant. He continued to sexually assault her. As far as the petitioner is concerned, it is alleged that when the Informant was getting ready to go to the village fair, he asked her to wear another dress and took her to the village.
4. Mr. Nilesh Kumar, learned counsel appearing on behalf of the petitioner, submitted that there is no allegation of rape against the petitioner and he is in custody since 04.12.2024.
5. Mr. V.S. Sahay, learned A.P.P has opposed the prayer for bail, but does not dispute the aforesaid facts.
6. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, POCSO, Latehar in connection with Garu P.S. Case No. 30 of 2024.
