ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“….to issue an appropriate Writ Order or orders or Direction more particularly one in the nature of Writ of Mandamus to declare the inaction of the respondents No. 3 to 5 not take any further steps to file final /report/charge sheet by completing the investigation in the FILE in crime No. 279/2019 dated 28-10-2019 with collusion of the 6th respondent is highly illegal, arbitrary, violation of Art 14,19 (g) 21 and 300 (A) of Constitution of India and also violation of Principles of Natural Justice. Consequently direct the respondents No. 3 to 5 to conduct proper further investigation, enquiry to file Final report/ charge sheet with competent investigation officer and pass…”
2. None appeared for the writ petitioner though the matter is posted under the caption 8for dismissal9. 3. Learned Assistant Government Pleader for Home on written instructions would submit that police conducted investigation into Crime No.279 of 2019 under Sections 420, 506 IPC of Eluru I Town Police Station and completed investigation and laid charge sheet on 14.11.2020 vide C.C.No.427 of 2020 and the same is coming up for trial before the learned Magistrate. 4. The writ petition is filed alleging that police not conducting investigation into Crime No.279 of 2019. 5. Now, the submissions made by the learned Assistant Government Pleader for Home would disclose that the police
4 completed the investigation, while pending the writ petition and laid charge sheet before the learned Magistrate and the same is coming up for trial. 6. In that view of the matter, cause does not survive for further adjudication and the writ petition has become infructuous. 7. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, interlocutory applications, if any, pending in this Writ Petition shall stand closed. ______________________________ JUSTICE B.V.L.N.
