GP FOR REVENUE 3 HBKM,J W.P.No.17688 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondent Nos.2 to 4 in threatening the petitioners to dispossess from their lands to an extent of Ac.3.08 cents in Sy.No.117-3, Ac.0.17 cents in Sy.No.117-5 and Ac.0.33 cents in Sy.No.117-10 of Boppadam Village, Nellimarla Mandal, Vizianagaram District for the purpose of granting house site pattas under the Navaratnalu Scheme without issuing notice and without following the due process of law. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that the subject lands in an extent of Ac.3.08 cents in Sy.No.117-3, Ac.0.17 cents in Sy.No.117-5 and Ac.0.33 cents in Sy.No.117-10 of Boppadam Village, Nellimarla Mandal are recorded as AWD (Gayalu) in the Settlement Fair Adangal and FCO fair adangal. These lands are not assigned to anyone. At present only the vacant lands in the above fields have been proposed for construction of RBK and house sites to the weaker sections in the village. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject lands in an extent of Ac.3.08 cents in Sy.No.117-3, Ac.0.17 cents in Sy.No.117-5 and Ac.0.33 cents in 4 HBKM,J W.P.No.17688 of 2020 Sy.No.117-10 of Boppadam Village, Nellimarla Mandal, Vizianagaram District strictly in accordance with law, if so warranted for any public purpose and the encroachments, if any, in the Government land shall be removed, strictly by following the due procedure, to utilize the same for any public purpose having laudable object. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
