This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 44/2025 registered at Police Station – Civil Lines, Raipur, District – Raipur (C.G.), for the offence punishable under Sections 317(2), 317(4), 317(5),111, 3 (5) of the Bhartiya Nyaya Sanhita, 2023. 2. 2 Sagar Singh wanted to purchase a SIM for his mobile then he introduced him with co-accused K.K. Vanshi. Only a memorandum of the applicant is recorded and nothing incriminating has been seized from him. That, after completion of the investigation Charge-sheet has filed by police. 3. Learned counsel for the applicant would submit that the present applicant is innocent person and has been falsely implicated in this case. He submits that the applicant is in jail since 24.06.2025, i.e., for more than two months, and therefore, he may be released on bail in the interest of justice. The charge sheet has already been filed by the police, and the trial will take considerable time to conclude. As per the prosecution, the present applicant was introduced to co-accused K.K. Vanshi by co-accused Sagar Singh, who wanted to purchase a SIM for his mobile phone; however, only a memorandum of the applicant has been recorded, and nothing incriminating has been seized from him. The applicant is a permanent resident of H.I.G. 0853, Ward No. 24, Housing Board, Near SBI Bank, 32 Acre, Durg (C.G.), and therefore, there is no likelihood of his absconding.
The applicant is ready and willing to abide by all such directions and conditions as may be imposed by this Hon’ble Court, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the charge-sheet has already been submitted before the competent Court in the present case. He submits that in compliance with this Hon’ble Court’s order dated 07.10.2025, the Senior Superintendent of Police, Raipur submitted an
3 affidavit during the course of investigation, a memorandum statement was taken from the previously arrested co-accused POS Agent K. Vanshi Soni, mobile number 8269438140, who stated that the accused Dilawar Singh, mobile number 7692922100, had fraudulently obtained SIM cards and sold them for Rs. 400 per SIM. During investigation, the accused Dilawar Singh was summoned to the Police Station, and a notice under Section 35(3) of the BNSS, 2023 was issued to him to appear and submit a conciliatory reply. His memorandum statement was recorded in the presence of witnesses, wherein he admitted that one of his friends, Sagar Singh, resident of Bhilai, mobile number 7898378157, had asked him for a SIM card, and accordingly, he contacted his acquaintance K. Vanshi @ Vamshi Soni, who used to sell SIMs by setting up an Airtel Stall near Polytechnic College. On the request of the applicant, six Airtel SIMs bearing numbers 7024241570, 7400721217, 9109116681, 7024257956, 8109588647, and 9109947030 were provided to Sagar Singh through the applicant at the rate of Rs. 500 per SIM, and the applicant also introduced Sagar Singh to K. Vanshi @ Vamshi Soni. During further investigation, a notice under Section 94 of the BNSS, 2023 was served upon the applicant to furnish a proper reply regarding the SIMs obtained through fraudulent means and to produce valid license documents and details of the money received.
However, the applicant failed to provide a satisfactory explanation and did not cooperate in the investigation or assist in tracing other accused persons. Consequently, to ensure his presence before the Court, the accused was arrested on 24.06.2025 in the presence of witnesses after being informed of his arrest and his family members were duly notified. Subsequently, after the completion of the
4 judicial remand period of the earlier arrested accused and upon finding sufficient evidence, the Investigating Officer obtained necessary permission from the IGP under Section 193(9) of the BNSS, 2023, and the original case diary was sent to Police Station Civil Lines, Raipur, for preparation of the charge sheet. Thereafter, on 21.04.2025, the charge sheet and supplementary charge sheet were presented before the learned CJM, Raipur, in Criminal Case No. 14374/2025, which is pending consideration. Later, during re-investigation to trace other accused persons, 13 more accused were arrested, and a supplementary charge sheet dated 12.08.2025 was filed before the learned Court. The present applicant was arrested on 22.08.2025 and is presently lodged in Central Jail, Raipur. Considering the gravity of the offence and the manner in which the applicant was involved in obtaining and selling fraudulent SIMs, there is a strong possibility that, if released on bail, he may abscond, tamper with evidence, or influence witnesses. Therefore, the applicant does not deserve the benefit of bail. 5. Learned State counsel further submits that the bail of other co-accused persons, namely, Anupam Shukla, Praveen Thakur and Om Aarya in MCRC No. 3846 of 2025, MCRC No. 3996 of 2025 and MCRC No. 4011 of 2025 have already been rejected by this Court, vide order dated 22.05.2025, therefore, the bail application of the present applicant is also entitled to be rejected. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7.
Considering the facts and circumstances of the case and the fact that
5 present applicant was actively involved in the commission of cyber fraud and further the bail of other co-accused persons, namely, Anupam Shukla, Praveen Thakur and Om Aarya in MCRC No. 3846 of 2025, MCRC No. 3996 of 2025 and MCRC No. 4011 of 2025 have already been rejected by this Court, vide order dated 22.05.2025, therefore, this Court is of the opinion that the present is also not it a fit case to enlarge the applicant on bail. 8. Accordingly, the bail application of the applicant – Dilawar Singh, filed under Section 483 of the BNSS, involved in Crime No. 44/2025 registered at Police Station – Civil Lines, Raipur, District – Raipur (C.G.), for the offence punishable under Sections 317(2), 317(4), 317(5),111, 3 (5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
