3. Applicant appearing in person submitted that the opposite party Nos. 2 and 3 have lodged the case under Section 125 Cr.P.C. making false and baseless allegations and they were awarded interim maintenance by order dated 01.08.2024. Thereafter, opposite party Nos. 2 and 3 have initiated proceedings under Section 125(3) Cr.P.C. vide misc. case no. 375 of 2025. It was submitted that before issuance of recovery warrant vide order dated 04.04.2025 no opportunity of hearing or filing objection has been provided to the applicant. It was pointed out that as per provisions of Section 125(3) Cr.P.C. recovery warrants can be
issued when the concerned person fails without sufficient cause to comply with the order of court. Applicant further submitted that the impugned order dated 04.04.2025 is against facts and law and thus, liable to be set aside. 4. Learned AGA has opposed the application. 5. So far impugned order dated 04.04.2025 is concerned, it is provided that in case applicant files his objection against the recovery warrants within a period of two weeks from today, the same shall be considered and decided by the Family court concerned expeditiously in accordance with law.
For a period of two weeks from today or till the applicants files such an application, whichever is earlier, no coercive action shall be taken against the applicant in recovery proceedings of the aforesaid case. 6. So far the prayer for staying the order dated 01.08.2024 is concerned, by that order interim maintenance has been granted by the Family court. In view of provisions of Section - 19 of Family Court Act, 1984 and the law laid down in case of Smt. Anjana Mukhopadhyay Vs. State of U.P. and Another 2023:AHC:2129445, Ashu Jain Vs. State of U.P. and 3 Others 2023:AHC:165660 and Liaqat Hussain Vs. Jainab Praveen and Another AIRONLINE 2020 ALL 2497, it is clear that an order of maintenance or interim maintenance passed by Family court is not an interlocutory order and that against such orders, aggrieved person has remedy of revision. It was held that against such order, application under Section - 482 Cr.P.C./528 BNSS is not maintainable. Further, the order of interim maintenance cannot be stayed merely on the ground that an application has been filed by the applicant/husband under Section 340 Cr.P.C./379 BNSS. However applicant would be at liberty to file a criminal revision or
to resort appropriate remedy in accordance with law against that
order. Thus, the prayer sought by the applicant in respect of order dated 01.08.2024 is refused.
7. The application under Section 528 BNSS is disposed of in above terms.
