GP FOR REVENUE 3 HBKM,J W.P.No.9703 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondent Nos.1 to 4. Inspite of service of notice, none appears for the 5th respondent. 2. This writ petition was filed questioning the notice issued by the 4th respondent dated nil/2020 to the petitioners calling upon them to attend his office and produce all the documents relating to their lands situated in RS.No.1 of Mallavalli Village, Bapulapadu Mandal Krishna District and the action of the 4th respondent in demanding the petitioners to vacate the land in an extent of Ac.2.00 cents and to hand over the same to the 5th respondent. 3. The learned counsel for the petitioners submits that the 4th respondent issued the impugned notice dated nil/2020 for the purpose of enquiry with respect to the assignments made in favour of the petitioners for the subject land covered under the D-form pattas in RS.No.1 of Mallavalli Village, Bapulapadu Mandal, Krishna District in an extent of Ac.2.50 cents as detailed in the said D-form Pattas issued in favour of the petitioners separately. The 1st petitioner claims 2½ Acres, the 2nd petitioner claims 2½ Acres, the 3rd petitioner claims 2½ Acres and the 4th petitioner claims 2½ Acres. 4. On the other hand, the learned Assistant Government Pleader appearing for the respondent Nos.1 to 4 submits that the 4th respondent will 4 HBKM,J W.P.No.9703 of 2020 proceed in accordance with law pursuant to the above said notice issued to the petitioners. 5. In view of the above said facts and circumstances, the petitioners are permitted to submit their explanation, enclosing all the necessary documents in support of their claim to the above said notice of the 4th respondent within a period of two (02) weeks from the date of receipt of this order. On receipt of the same, the 4th respondent shall proceed with the necessary enquiry, by giving due opportunity to all the parties concerned including the petitioners and the 5th respondent with respect to the subject land and upon verification of the records and the subject land, appropriate decision shall be taken on its own merits preferably within a period of four (04) months thereafter. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
