The petitioner has been made accused in connection with Haidernagar P.S. Case No. 69 of 2024 (POCSO Case No.03 of 2025), for the offences registered under Sections 65(1) of the B.N.S., 2023 and Sections 4 and 8 of the POCSO Act, pending in the Court of learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj. On 15.08.2024, petitioner is alleged to have raped 13 years old victim. Attention has been drawn towards the statement of the victim recorded during trial. From perusal of which, it appears that victim has not supported the prosecution case and as such, she has been declared hostile. In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj, in connection with Haidernagar P.S.
