This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue a writ, order or a direction, more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents No. 2 to 4 in interfering into civil disputes and threatening to dispossess the Petitioners and the society from the Landed Property in an extent of Ac.8.73 cents., covered by S.No.325/1, 325/2, 325/3. TD.No.186, situated at Sathivanipalem Village, H/o Narava, Pendurthi Mandal, Visakhapatnam District, as illegal irregular, arbitrary violative of the provisions of the Criminal Procedure Code and also offends Articles 14, 21 and 300-A of the Constitution of India and consequently direct the official Respondent No.2 to 4 not to interfere into the civil disputes and pass.”
2. Heard Sri Mangena Sree Rama Rao, learned counsel for the petitioners and Sri Ajay Babu, learned Assistant Government Pleader for Home. 3.
It is a case of interference of police in a civil dispute. 4. Learned Assistant Government Pleader for Home would submit that based on the complaint made by respondent No.5, police registered a case against the petitioners herein and others in Crime No.79 of 2023 for the offences punishable under Sections 447 and 427 read with 34 IPC. 5. Recording the said submissions, the Writ Petition is disposed of. However, the police are directed to follow due process of law regarding the crime which is registered against the petitioners.
