ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, seeking the following relief:
“(i) Writ of mandamus, directing the respondent No.1 to ensure that the respondent No.2 shall pay and release the salary to the petitioner and put him in service in terms of Communication dated 13.06.2024 in No.DRP:Manavi:3/2024-25 issued by the respondent No.1, vide Annexure-A, pursuant to the representation dated 31.05.2024 and representation dated 25.11.2024 submitted by the petitioner to the respondent Nos. 1 and 2 respectively, vide Annexures A1 and A2, respectively.”

2. The case of the petitioner is that, he was working as a Branch Manager in the second respondent – Bank.
For the period from 31.05.2024 to 14.06.2024 arrears of salary has to be paid by the second respondent. Hence, the petitioner has approached the first respondent by filing representation dated 31.05.2024 (Annexure-A1). In turn, the first respondent sent a communication to the second respondent, dated 13.06.2024 (Annexure-A) by directing the second respondent to pay the arrears to the petitioner. In spite of that, the second respondent has not paid the arrears. Therefore, the petitioner is before this Court. 3. At outset, the learned AGA submits that, the dispute is between the petitioner and a private bank. Therefore, the writ petition filed by the petitioner itself is not maintainable. He further submits that the petitioner has an alternative remedy under Section 70(1)(c) of the Karnataka Co-operative Societies Act, 1959. - 4 -

4. In view of the above, this writ petition is disposed of, reserving liberty to the petitioner to approach the competent authority under the Karnataka Co-operative Societies Act. 5.
