This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 234/2025 registered at Police Station – Jaynagar District – Surajpur (C.G.) for offence punishable under Sections 318(4), 336(3), 337, 338 & 340 of the BNS. 2. As per the prosecution case, the applicant is accused of submitting forged documents in a revenue case pending before the Court of the Sub-Divisional Officer (Revenue), Surajpur. It is alleged that in VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.10.31 12:24:35 +0530 2 Revenue Case No. 202402260300187/A-6-A/2023-24, filed on behalf of the applicant, a forged order purportedly passed by the Revenue Board, Chhattisgarh in Case No. M/Miscellaneous/26/R/B- 121/95/2023 against Randeep Singh and the Government of Chhattisgarh, dated 04.10.2023, was produced. The said document was alleged to have been used to influence the proceedings before the Sub-Divisional Officer (Revenue), Surajpur. Upon verification, it was found that the Revenue Board had not passed any such operative order in favour of the applicant, and in fact, the case had already been rejected as not pending. Accordingly, it is alleged that the applicant intentionally submitted a forged and fabricated document with the intention to mislead the revenue authorities and derive an undue advantage in the said case. 3. The applicant respectfully submits that he is innocent and has been falsely implicated in the present case due to personal grudge and ulterior motives. It is alleged that he submitted forged documents in a revenue case pending before the Court of Sub-Divisional Officer (Revenue), Surajpur; however, the applicant himself is a victim of fraud and has not committed any act constituting a criminal offence. The case diary reveals that in Revenue Case No. 202402260300187/A-6-A/2023-24, an order dated 04.10.2023 purportedly passed by the Revenue Board, Chhattisgarh, in Case No. M/Misc./26/R/B-121/95/2023, was alleged to have been fabricated and submitted by the applicant, which he categorically denies. The applicant had earlier lodged a written complaint before the District Magistrate, Surajpur, and the Sub-Divisional Officer (Revenue), Surajpur, against one Mohammad Dastagir regarding similar forged 3 transactions, which is still under investigation. A similar case registered against the applicant at Police Station Ambikapur vide Crime No. 261/2024, having identical allegations, resulted in this Hon’ble Court granting him anticipatory bail vide order dated 09.05.2025 in MCRCA No. 567/2025, therefore, on the principle of parity, the applicant deserves the same relief in the present case. The applicant is a permanent resident of the address mentioned in the cause title, has deep roots in society, and there is no likelihood of his absconding or tampering with evidence. He apprehends arrest and harassment despite being innocent and is ready to furnish adequate surety and comply with all conditions that may be imposed by this Hon’ble Court, therefore he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel, appearing for the non- applicant/State, opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary and further considering the fact that the other similarly situated co-accused persons have been granted anticipatory bail by this Court vide order dated 09.05.2025 passed in MCRC No. 567/2025, this Court, without expressing any opinion on the merits, is inclined to grant anticipatory bail to the present applicant. 4 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Randeep Singh, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
