Neutral Citation No. - 2025:AHC:64853 Court No. - 4 Case :- WRIT - A No. - 5516 of 2025 Petitioner :- Ravi Nagar Respondent :- State of U.P. and Another Counsel for Petitioner :- Prabhakar Nath Tripathi,Ratnesh Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard Prabhakar Nath Tripathi, learned counsel for the petitioner as well as Ms. Archana Tyagi, learned Additional Chief Standing Counsel appearing for State respondents. 2. By means of this petition filed under Article 226 of the Constitution, petitioner has assailed the final results of U.P. Police Constable Direct Recruitment, 2023 on the ground that his answers to two questions were wrongly taken to be not correct and if the objections are directed to be decided then the petitioner has a very fair chance to find place in the merit list as he would then stand awarded with marks for those two questions for which marks have been denied on account of petitioner opting alleged wrong answers which otherwise were correct. 3. Upon a pointed query being made, learned counsel for the petitioner admits that the petitioner did not file any objections to the answers of two relevant questions at the time when the provisional answer key was published by the respondents and objections were invited. 4. In the considered view of the Court every recruitment for public employment is to be governed by a scheduled program and as per procedure prescribed under the relevant recruitment rules and the examination policy to be adopted by the selecting body. In matters of multiple choice question test where the options are given, at times it may happen that answer given to a particular question turn out to be wrong and it is for this reason that objections are invited online while making the objection-tracker live and every candidate in such an event has an opportunity to file objections. After the objections are filed and objection tracker is closed and a body of experts constituted to evaluate the objections, tenders its opinion and resultantly final answer key is prepared, in my considered view no further objections can be directed to be entertained. If this is permitted then it would result in two things which may not be justified: (a) this Court will be sitting in appeal over and above the opinion of the expert body without there being any expertise and skill with it in specialized subjects for which the questions may have been formulated in the multiple choice question paper; and (b) it would result in a never ending process in respect of selection in public employment which again will prejudice the rights and interest of those candidates who had rightly opted the answers and had been placed in the merit list. 5. In view of the above, since petitioner failed to file objections within time frame prescribed by the recruitment authority, no relief now can be granted to the petitioner after the final results have been published on 13.03.2025 in respect of the U.P. Police Constable Recruitment 2023. 6. Petition is accordingly held to be devoid of merit and hence dismissed.
