$~89 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 13227/2025 VIKAS KUMAR .....Petitioner Through: In person. versus UNIVERSITY OF DELHI & ORS. .....Respondents Through: Mr. Mohinder J.S. Rupal, Mr. Hardik Rupal and Ms. Aishwarya Malhotra, Advocates for University of Delhi. CORAM:
HON'BLE MR. JUSTICE VIKAS MAHAJAN O R D E R % 17.10.2025
1. The present petition has been filed by petitioner seeking following reliefs:
“a) issue writ in the nature of mandamus directing the Respondent University to hold 5th term supplementary exam for Criminology Paper (Paper Code: LB-5033) as a special case in the month of September, 2025 and for issuance of a further writ of certiorari for quashing letter containing reference No. Exam VII /2025/17 dated 4th August, 2025 issued by Joint Registrar [Exams] University of Delhi, whereby and where under a letter dated 10.7.2025 by the petitioner for one special chance to re- appear in 5th term supplementary exam for the criminology paper (paper code LB-5033), which exam was missed on account of non-communication of change of date for the exam.”
2. The grievance articulated by petitioner in the present petition is that he was admitted to 3 year LL.B Course in Law Centre-1, Faculty of Law, Delhi University through competitive examination for the session 2021-
2024. However, due to unavoidable circumstances, petitioner could not clear his two papers of 5th Semester, held in January, 2025, namely, (i) Industrial Law and (ii) Criminology. 3. The petitioner thereafter, applied for supplementary examination, scheduled in July, 2025. He duly filled the form and deposited the requisite fee. The admit card was also issued by the respondent no.1 University (hereinafter referred to as ‘university’). 4. As per the date-sheet downloaded on 24.06.2025 from the examination branch’s website, the exam of Industrial Law was scheduled on 04.07.2025 whereas the exam of Criminology was scheduled on 10.07.2025. 5. The petitioner who is appearing in person submits that he appeared for Industrial Law exam on 04.07.2025, but for the Criminology exam, when he went to the examination centre on 10.07.2025, it transpired that the said exam had been pre-poned to 09.07.2025.
He submits that such preponement was done by University without any intimation by e-mail or whatsapp. Further, no notice was displayed on the notice board of Law Centre-I.
6. He, therefore, urges the Court that he may be given a special chance and the paper of the Criminology must be conducted by the respondent no.1 University at the earliest so that the petitioner could pursue his future avenues after obtaining the LL.B. Degree. 7. On a query posed by the Court, Mr. Mohinder J.S. Rupal, learned counsel appearing on behalf of University, on instructions, submits that classes of 5th Semester will be over on 26.11.2025 and the exam of 5th Semester will be held in due course in the month of December, 2025. 8. On further being queried as to when the result will be declared, he submits that result is also likely to be declared in the month of January,
2026. However, in the event, the result of petitioner is not declared in the month of January, 2026, he can get his result expedited in the peculiar facts and circumstances of the present case. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 25/10/2025 at 14:16:54
9. This Court finds that the date fixed for conducting the exam of criminology was 10.07.2025 and the same was preponed. Undoubtedly, the preponement was notified by University on its website, but the same was not personally circulated to the candidates. Mere posting of information on the website by the University without candidates having been specifically informed is of no avail especially in case where the examination date is preponed. 10.
But, since the examination for 5th Semester is going to be held in the month of December, 2025, this Court is of the view that no direction can be given to the University to specially conduct an exam for the petitioner, as this will lead to formidable difficulties of assessing, compiling and declaring separate result only for one person. 11. As the 5th Semester exams are round the corner, the petitioner may take his supplementary examination in the subject of Criminology in the ensuing exams of 5th Semester which are going to be held in the month of December, 2025, as stated by Mr. Rupal. 12. In the event, result of petitioner is not declared in the month of January, 2026, he shall be at liberty to have the same expedited. Petitioner is also at liberty to approach this court for the said purpose. 13. Petition stands disposed of in the above terms. VIKAS MAHAJAN, J OCTOBER 17, 2025/jg This is a digitally signed order.
