Mr. Gopal Khare, learned advocate appears on behalf of petitioner and submits, respondent no.5 (the Gaon Sabha) is seeking to construct drain over his client's land recorded as Gata no. 517 in village Kakori, Tehsil Jhansi. His client had made application dated 16th April, 2024 to respondent no. 2. He seeks direction upon said respondent to compel respondent no.5 to comply with provision under section 33 of U.P. Panchayat Raj Act, 1947. 2. Mr. Devesh Vikram, learned advocate Additional Chief Standing Counsel appears on behalf of State and with reference to paragraph 9 submits, criminal case was filed before this Court. 3. Mr. Deepak Gaur, learned advocate appears for respondent no. 5 (Gaun Sabha). 4. Respondent no.2 (Sub Divisional Magistrate) is directed to consider petitioner's application dated 16th April, 2024. For the purpose, the authority might require assistance from respondent nos. 4 and 5, particularly since respondent no.4, as alleged by petitioner, had initiated case without impleading him. 5. Petitioner will communicate certified copy of this order along with copy of his application dated 16th April, 2024 to respondent no. 2. 6.
