JUSTICE CHANDRA PRAKASH SHRIMALI Order 07/11/2025 1. These bail applications have been filed by the accused- petitioners under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, who have been arrested in connection with FIR No.62/2025 registered at Police Station Todgarh, District Beawar for the offences under Sections 331(4) & 305(a) of BNS. 2. Learned counsels for the petitioners submit that the accused- petitioners are innocent and they have been falsely implicated in these cases. They also submit that the accused-petitioners have been in judicial custody since long time and the conclusion of the trial will take long time, hence, petitioners may be enlarged on bail. 3. Learned Public Prosecutor appearing for the State has vehemently opposed the bail applications. 4. Heard learned counsels for the petitioners as well as learned Public Prosecutor and perused the material available on record. 5. Taking into consideration the overall facts and circumstances of the case but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 6. Accordingly, these bail applications are allowed and it is ordered that the accused-petitioners (1) Himmat Singh S/o Kishan Singh (2) Surendra Singh S/o Shri Bajrang Singh (3) Pintu Singh S/o Shri Anop Singh be released on bail provided they furnish a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties of Rs.50,000/- [2025:RJ-JP:44760] (3 of 3) [CRLMB-13045/2025] (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court for their appearance before the Court concerned on all subsequent dates of hearing and as and when called upon to do so. 7. Considering the criminal antecedents of the accused- petitioners, it is directed that in case, if they are found to be involved in offences of similar nature, the prosecution shall be at liberty to file an application for cancellation of the bail granted to the accused-petitioners by this Court.
