V R REDDY KOVVURI 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 25758 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: <…to issue a Writ or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos. 2 and 3 in calling the petitioners to settle the dispute in Lok Adalat with the 4th respondent in respect of Sy.No.304-1, an extent of Ac.1.00 cents situated at Hindupur Village and Mandal, Sri Satya Sai District as a dispute is pending in Competent Criminal Court in CC.No.946/2023 on the file of Honourable Judicial First Class Magistrate, Hindupur, Sri Satya Sai District and AS.No.357/2019 pending on the file of Honourable High Court of Andhra Pradesh is illegal, arbitrary and violation of principles of natural justice and consequently direct the respondent Nos.2 and 3 not to interfere in a Civil dispute pending between the petitioners and 4th respondent in respect of Sy.No.304-1, an extent of Ac.1.00 cents situated at Hindupur Village and Mandal, Sri Satya Sai District.…= 2. Heard Sri K.Srinivas, learned counsel for the petitioners and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioners would submit that the respondent- police are interfering with the civil disputes between the petitioners and the unofficial respondent. 4. Learned Assistant Government Pleader for Home, by way of counter would submit that a case in Cr.No.61 of 2023 under Sections 420 & 468 of IPC, 156(3) of Cr.P.C., dated 25.04.2023 was registered against the petitioners on the directions of the learned Judicial First Class Magistrate 4 Court, Hindupur. After due investigation, charge sheet is filed in the above crime vide C.C.No.946 of 2023. The matter was coming up for appearance of the accused. The learned Trial Court has issued summons to the accused therein with a direction to appear before the Court on 09.10.2023. The respondent police have served the summons to the accused as per the directions of the Court. Except for the purpose of serving the summons to the accused, the police never called the petitioners to the police station and never interfered in the civil disputes between the parties. 5. Recording the same, this Writ Petition is disposed of. No order as to costs. However, the police are directed not to interfere in the civil disputes between the parties, except under due process of law.
