Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for the following relief: "Issue a writ order or direction in the nature of mandamus commanding/directing the respondent No.3 (Sub Divisional Magistrate. Tehsil Kaptanganj, District Kushinagar) to take appropriate steps towards demarcation of chak marg situated nearby Arazi No. 56 with area 1.023 Hectare in village Rampur, Chaubey, Barwa, Kushinagar." 3. Contention of the learned counsel for the petitioner is that the petitioner has moved an application for demarcation of the land as well as land of chak road which is pending since 04.02.2025. He prayed that the same may be decided, expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with liberty to the petitioner to move appropriate application for demarcation under Section 24 of the U.P. Revenue Code, 2006, and respondent No. 3 shall consider and decide the application of the petitioner for demarcation, in accordance with law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon all the opposite parties and giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
