1. By way of the instant application the petitioner has prayed for the following prayer:- It is therefore, most humbly and respectfully prayed that this Hon’ble Court may kindly be pleased to allow the instant application, in the interest of justice and grant further 45 days’ time to deposit the entire sum including the increased sum with the concerned authorities of Bilaspur Municipal Corporation.

The brief facts of the case are that the petitioner filed a writ petition bearing WPC No.4780 of 2025 before this Court with a prayer to quash the shop cancellation notice dated 05/08/2025 as well as the tender inviting notice/auction notice dated 14/08/2025 and the petitioner be given a chance to repay the money to the respondent Bilaspur Municipal Corporation for the shop No.D/13. This Court by order dated 04/09/2025 disposed of the said writ petition directing the petitioner to deposit the entire /rest of the amount before the respondent /Municipal Corporation within a period of 30 days including the amount which incurred towards the paper publication along with interest.

Learned counsel for the petitioner would contend that the petitioner being a mentally challenged person and is managing his business with the help of his father and brother and it is difficult for him to manage such a huge amount in a month. He would next contend that in such circumstances further 45 days time may be granted to the petitioner to deposit the entire sum including the increased amount.

Per contra, learned State counsel as well as learned counsel for the respondent Municipal Corporation would oppose the submission made by learned counsel for the petitioner and would submit that the Court has granted liberty to proceed against the petitioner as per the tender/auction notice dated 14/08/2025 in case the petitioner fails to deposit the amount.
5. I have heard learned counsel for the parties and perused the documents.
6. Considering the entire facts & circumstances of the case and the
submissions made by learned counsel for the petitioner, this Court deems it appropriate to grant further 45 days time from today to deposit the amount entire/rest amount with the concerned authorities of Bilaspur Municipal Corporation. It is ordered accordingly.
7. With the aforesaid observation, the instant MCC stands disposed of. SSD/- (Arvind Kumar Verma)
