Neutral Citation No. - 2025:AHC:137284 Court No. - 52 Case :- WRIT - A No. - 59632 of 2014 Petitioner :- Ram Nayan Respondent :- State Of U.P. Thru Secry. And 5 Others Counsel for Petitioner :- Yogish Kumar Saxena Counsel for Respondent :- Babu Ram Yadav,Nikhil Kumar Hon'ble Mrs. Manju Rani Chauhan,J. Case is called out. None appears for the petitioner. Learned Standing Counsel for the State is present. Record shows that the present petition has been filed with the prayer to quash the impugned order dated 10.10.2014, passed by respondent no.2 as far as it relates to the posting of respondent no.5 to the petitioner's post and a further prayer to direct the respondents to allow the petitioner to continue on his post, in accordance with law. The case is listed in the category of oldest pending cases in the cause list, for priority hearing. A notice has also been placed on the notice board specifically, mentioning that "old cases up to the year 2022 shall be taken up in the first round itself. In case of non-appearance, matter shall be dismissed as infructuous or otherwise, and in the cases, where the cause of action still survives, the concerned advocates are expected to mark them accordingly in the cause list. Failure to do so, may result in its dismissal as infructuous" but, neither the counsel for the petitioner has appeared nor has the case been marked to indicate that the cause of action still survives. This matter is pending since 2014. It appears that either the petitioner has lost interest in pursuing the matter or it has become infructuous. Accordingly, the petition is dismissed as infructuous.
