Neutral Citation No. - 2025:AHC:47020 Court No. - 6 Case :- WRIT - A No. - 59743 of 2014 Petitioner :- Girija Prasad Tirpathi And 7 Ors Respondent :- State Of U.P. And 2 Ors Counsel for Petitioner :- Vikrant Pandey Counsel for Respondent :- Harendra Yadav,Mangala Prasad Rai Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Vikrant Pandey, learned counsel for petitioner and perused the record.
2. Petitioner may have a good case on basis of subsequent events such as amendment in National Council for Teachers Education Act, 1993 that he may be entitled for relaxation of age to participate in Special B.T.C. Examination. However, an adverse factor at this stage is that petitioner is now aged about 59 years, therefore, even age relaxation is granted, petitioner may have a few months of service, which could not be a ground to exercise discretionary power provided under Article 226 of The Constitution.
3. In aforesaid circumstances, since by efflux of time prayer made in this writ petition has rendered infructuous, therefore, the writ petition is accordingly dismissed. Order Date :- 3.4.2025 AK Digitally signed by :- AWADESH KUMAR High Court of Judicature at Allahabad
