This writ petition has been filed with the following prayer:- "i) To exercise it powers of superintendence as enshrined under Article 227 of the constitution of India to direct the Civil Judge/Small Cause Court, Allahabad to decide Mutation Appeal No. 44 of 2023 (Raza Imam & Another Vs. Zonal Officer, Zone No. 1 Nagar Nigam, Prayagraj & Another) within a stipulated period as fixed by this Hon'ble Court preferably within a period of 3 months, after giving opportunity of hearing to both side in accordance with law;" 2. It is contended by learned counsel for the petitioner that Mutation Appeal No. 44 of 2023 is pending consideration before Civil Judge/Small Cause Court, Allahabad. The sole prayer made is for expeditious disposal of the said appeal. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Civil Judge/Small Cause Court, Allahabad to decide the Mutation Appeal No. 44 of 2023, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
